1. Acceptance of Terms

By placing an order with Concrete Near Me (“Company”, “we”, “us”, or “our”), you (“Client”, “Customer”, or “you”) agree to the following Terms & Conditions. These terms apply to all concrete delivery services provided by Concrete Near Me in Ontario, Canada. If you do not agree to these terms, please do not proceed with using our services.

 

2. Nature of Service

Concrete Near Me specializes in on-site concrete mixing using volumetric trucks. This service allows the customer to:

  • Receive fresh concrete mixed to specification on location.
  • Pay only for the volume of concrete used (minimum charges apply).
  • Adjust the mix or quantity on site, subject to truck capacity and material availability.

Our services are available across Ontario, subject to scheduling and location accessibility.

 

3. Service Agreement & Orders

3.1 Booking

All orders must be scheduled in advance. Orders are not confirmed until you receive written confirmation (via email, text, or invoice) from one of our representatives.

3.2 Minimum Charges

All deliveries are subject to a minimum charge as outlined in your quotation or invoice. Even if less concrete is used, the minimum will still apply.

3.3 Delivery Times

While we strive to arrive on time, delivery times are estimates. We are not liable for delays caused by traffic, weather, site accessibility, or other unforeseen events. We recommend you plan accordingly.

 

4. Pricing & Payment

4.1 Pricing Structure

Pricing is based on:

  • Volume (cubic metres) of concrete used;
  • Type of mix;
  • Distance to the site;
  • Labour duration;
  • Special additives or customizations (e.g., air, super plasticizer(water reducer), accelerants).

All pricing is in Canadian Dollars (CAD) and excludes HST unless otherwise noted.

4.2 Payment Terms

Pre-Authorization Payments are due prior to delivery unless otherwise arranged in writing. Accepted methods:

  • Credit/debit cards
  • E-transfer (to sales@concretenearme.ca)

Pre-Authorization payment is 30% above the quoted price provided at the time of ordering.

Interest of 2% per month (24% annually) may apply to overdue balances.

4.3 Cancellation

Cancellations less than 4 hours prior to scheduled delivery may be subject to a $500.00 cancellation fee to cover preparation and travel costs. 

 

5. Site Conditions & Responsibilities

5.1 Access to Site

Clients must ensure:

  • Safe and legal access for our trucks;
  • Adequate turning and operating room;
  • A surface firm enough to support vehicle weight;
  • A suitable washout location after the delivery has been completed.

We reserve the right to refuse delivery or adjust the drop point if conditions are unsafe or unsuitable.

5.2 Liability for Damage

We take care in accessing your site. However, we are not liable for:

  • Damage to driveways, curbs, sidewalks, landscaping, underground utilities, or lawn;
  • Property damage due to poor site conditions or improper surface materials.

     

6. Concrete Specifications

6.1 Mix Specifications

All mixes are created on-site per customer instruction. It is the client’s responsibility to specify:

  • Strength (MPa), slump, and design details;
  • Additives or accessories required.

We advise all customers to consult a professional engineer if unsure.

6.2 Freshness & Usage

Concrete is perishable. Once onsite, it must be placed and finished promptly. We are not responsible for the suitability of concrete if delays or improper placing techniques occur after delivery.

 

7. Liability & Warranty

7.1 Warranty

We warrant that the concrete supplied will meet industry standards as per customer-provided specifications at the time of mixing. We do not guarantee:

  • Strength development if improper curing or placement occurs;
  • Performance in poorly designed or unprepped sites;
  • Colour consistency or aesthetic finish unless specifically arranged.

7.2 Limitation of Liability

To the fullest extent permitted by law, Concrete Near Me’s liability is limited to the value of the concrete delivered on the disputed order. Under no circumstances shall we be liable for indirect, consequential, or incidental damages.

 

8. Force Majeure

We are not liable for any delay or failure to deliver caused by events beyond our control, including but not limited to: weather delays, government restrictions, labour disputes, equipment breakdowns, or supply shortages.

 

9. Privacy

Customer and project data is kept confidential and is only used for fulfilling services, internal operations, and billing purposes. Please refer to our Privacy Policy for more details.

 

10. Governing Law

These terms are governed by and interpreted according to the laws and regulations of the Province of Ontario, and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ontario, Canada.

 

11. Amendments

Concrete Near Me reserves the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of our services after changes constitutes acceptance of the new terms.
